Question

Which philosophy of punishment do you think should guide the criminal justice system? Which philosophy of punishment is the least important to the criminal justice system? Why?

Response

There are four philosophies of punishment including retribution, deterrence, incapacitation and rehabilitation (and/or restoration).  Of these philosophies, the one I think should guide the criminal justice system is rehabilitation (and/or restoration).  According to Kurki and Morris (2002), 1.2 percent of inmates are held in supermax units of the Department of Corrections in the United States.  Upon release, most are released directly into society.
